Terms of Service

These terms govern your use of ZonePass, a zoning-information service operated by Ironvon Inc. By using ZonePass, you agree to these terms.
1. Acceptance of these terms
ZonePass (the "Service") is operated by Ironvon Inc. ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms of Service and by our Privacy Policy and Disclaimer, which are incorporated by reference. If you do not agree, do not use the Service.
2. What ZonePass provides
The Service lets you look up general zoning information for properties in supported Ontario municipalities and provides a simplified summary of common permitted uses. This information is provided for general informational and convenience purposes only and is not legal, planning, or professional advice. Please read the Disclaimer for important limitations on the accuracy and use of this information.
The Service is currently provided free of charge. Any future paid features will be subject to additional terms presented to you at the time, including payment and refund terms.
3. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these terms. You agree that you will not:
- scrape, harvest, crawl, or use automated means to extract data from the Service, or reproduce, resell, redistribute, or commercially exploit the Service or its content without our written permission;
- copy, modify, reverse engineer, decompile, or attempt to derive the source code or underlying data structures of the Service;
- interfere with, overload, or attempt to gain unauthorized access to the Service, its servers, or related systems;
- use the Service to violate any law, infringe any right, or in any way that could damage, disable, or impair the Service.
4. Intellectual property
The Service, including its software, design, text, and the compilation and presentation of zoning information, is owned by Ironvon Inc. and is protected by applicable intellectual property laws. The underlying zoning by-laws and municipal data are the property of, or in the public domain through, the relevant municipalities and other sources. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal or internal business use, subject to these terms.
5. Third-party services
The Service relies on third-party services, including Google Places for address geocoding. Your use of those features may be subject to the applicable third party's terms and privacy policies. We are not responsible for third-party services.
6. No warranty
The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of accuracy, completeness, merchantability, or fitness for a particular purpose, to the fullest extent permitted by law.
7. Limitation of liability
To the fullest extent permitted by applicable law, in no event will Ironvon Inc., its directors, officers, or operators be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss or damage arising from your use of, or reliance on, the Service or any information it provides, even if advised of the possibility of such damages. To the extent any liability cannot be excluded, our total aggregate liability is limited to the amount you paid us, if any, to use the Service in the twelve months preceding the claim (which, for a free service, is zero).
Consumer rights. If you use the Service as a consumer in Ontario, nothing in these terms removes or limits any rights or remedies you have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer-protection law that cannot legally be waived. Where such law applies, the limitations above apply only to the extent permitted by that law.
8. Indemnification
You agree to indemnify and hold harmless Ironvon Inc. and its operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these terms, or your violation of any law or the rights of a third party.
9. Changes to the Service and these terms
We may modify, suspend, or discontinue the Service, in whole or in part, at any time. We may also update these terms from time to time; the "Last updated" date above reflects the current version. Your continued use of the Service after changes take effect constitutes acceptance of the updated terms.
10. Governing law
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. You agree that the courts located in Ontario will have jurisdiction over any dispute arising out of or relating to these terms or the Service, subject to any non-waivable rights you have as a consumer.
